Welcome to BOYANTS.com, we are a sustainable marketplace digital operating system for the tourism ecosystem, facilitating access to destination and business development tools, conveniences and benefits for travelers and merchants.  We connect travelers with authentic and culturally valuable experiences, products and services in vibrant destinations around the World.  On the one hand, our platform offers travelers (Travelers or Visitors Users) tools for planning, purchasing and navigating the destination.  On the other hand, our platform offers innovative tools for the merchant of the tourism value chain (Merchant Users)  to market their unique and curated experiences, products and services,  and to develop new products collaboratively with other entrepreneurs and providers of the ecosystem. 

Through our digital platform www.boyants.com we offer consumers (Traveler User) the opportunity to acquire the experiences, products and / or services of third-party merchants (Merchant User), in the form of a BOYANT VISAS, with the exception of what is expressly identified.  BOYANT VISAS are experiences, products and services exclusively created and curated for our platform.  Each BOYANT VISAS includes a promotional value for a limited time, exchangeable for goods and services from merchants in the tourist value chain of the vibrant destination to visit.


BOYANT is not the one who offers the services identified and detailed in the BOYANT VISAS.  The promotion in each BOYANT VISA serves as a form of marketing, advertising, promotion and positioning for the Merchant User in the digital tourism ecosystem of the vibrant local destination in which they participate and / or in which they are interested in positioning their experiences, products and / or services.  The BOYANT VISAS available for sale at www.boyants.com are subject to these Terms and Conditions (TC’s), as well as to the TC’s and fine print of the particular offer. However, we are not a travel or excursion agency and we do not provide such experiences ourselves.  When you make a reservation, you will purchase a tour, experience, ticket, or other service directly from the third-party provider.


These TC’s apply to any use of the BOYANT services.  Please read these TC’s carefully as they contain important information about your legal rights and limitations on these rights, as well as a section on applicable law and jurisdiction of disputes.  By accessing or using BOYANTS services, you are indicating that you have read these TC’s and agree to be bound by them.  If you do not agree to all of these TC’s, you are not allowed to access or use the services.


    2.0 General Terms and Definitions


        2.1 General Terms


These TC's, together with the Privacy Policy establish the terms in which The Boyant Group LLC (a Puerto Rico corporation, along with certain specific affiliates and subsidiaries: "BOYANT", "we "," we, "our") provides services (the "Services") through the Boyant platform (the "Platform") that may be available through our website (www.boyants.com, along with all related domains, white label and affiliate sites, mobile properties and related applications, collectively the "Website") and by telephone. When we refer to "you", we mean anyone who accesses or uses the services.

These TC's govern your relationship with us with respect to your use of the Services, including the reservations you make for any tour, ticket, attraction, activity and / or experience (described in these TC’s as an "experience") that is advertised on the website and is available from a third-party vendor (each a "product").


By using or accessing the Services, by reserving a Product ("reserve") and / or by creating an account on the Website (a "Boyant Account"), you agree to be bound by these TC’s without modifications and declare that you have read and understood them.  In all reservation arrangements, the person making the reservation will be deemed to have accepted these TC’s on behalf of all persons named in the reservation.


We may update or modify these TC’s at any time, and you understand and agree that your continued access or use of the services after such change means that you accept the updated TC’s.  We will note the date the last updates to the Terms of Use were made at the top of this page, and the updated TC’s will take effect once they are posted.  It is your responsibility to return to this page periodically to review the most current version.


        2.2 Definitions

            2.2.1 As used in these T&C’s, the following terms, words or phrases will have the meanings described below:


 "Affiliates" means the affiliated entities or subsidiaries of The Boyant Group LLC, and their respective administrators, members, directors, employees, agents and / or representatives.


"Boyant" the term is used in reference to the digital platform and is the graphic brand of the company.  For definition purposes, the Boyant concept is inspired by two concepts;  In the first place it refers to the spirit of the traveler or flamboyant spirit and also refers to the buoyant force, that is, the driving force.


 "Boyant Visas" are the offers presented on the platform which are agreed with our merchant clients.  The term Boyant Visas refers to the credential issued with the purchase of the offer and serves as evidence of the visitor or traveler.


“Boyant Traveler User”- we refer to the visiting client or traveler consumer of BOYANT's experiences, products and services.


“Boyant Merchant User”- Companies, businessmen, entrepreneurs, cultural managers, producers and operators of the tourism value chain.


"Channel" or "Channels" mean websites, web pages, web portals, media, channels, platforms or applications known or to be developed and that are currently or in the future available, through which it is possible to access or use the Services and Contents offered by The Boyant Group LLC.  "Channels" include, but are not limited to, the Site, mobile applications, email, social media, communication services or mobile phones, messages or mobile application alerts (known as "push notifications" or "server push notifications" ”And that could be transmitted through devices- or beacons- that are in the vicinity of the User's equipment that is enabled to receive or send communications using Bluetooth wireless systems or through another type of system or technology), text messages (including "Short Message Service" or "SMS", and "Multimedia Messaging Services" or "MMS"), "Really Simple Syndication" or "RRS", among others.

"Public Spaces or Areas" means any digital space or area, application, service or program where or through which users can provide, upload ("upload"), transmit, publish, transfer or share information or content that can be examined, shared or accessed. by or with other users or third parties, and include (but are not limited to) blogs ("blogs"), discussion forums, comment sections, polls, video sharing media, photo sharing media, comments, messages, profiles, "chats", groups, social media, and any other means known in the present and / or developed or known in the future that allow users to provide information or content so that it can be examined by other users or by third parties.


 "Service" or "Services" include online access to: blog content, social media, speech forums, comment sections, classified ad services, special sales announcements, commercial announcements, offers, services, coupons, discounts, search services, newsletter services, email sending services, survey services, download services for a variety of content, APIs, applications, software or application download services and other services The Boyant Group.


"Site" means the sites, pages or web portals belonging to The Boyant Group.  The term "Site" includes, but is not limited to, www.boyants.com or any other site, page or web portal in which a link is placed or reference is made to these TC’s.


“UGC or User Generated Content” is content that you or other users upload, submit, post, distribute or make available to the services. Your communications on the services are not private or confidential and may be viewed by others accessing the Services. Our privacy policy applies to UGC. We reserve the right to, but have no duty to, review, edit, move or delete any UGC in our sole discretion and without notice. We do not endorse, support, sanction, encourage, verify or agree with the comments, opinions or statements posted as UGC. Any information or material placed online by other users is the view and responsibility of those Users and does not represent the view of BOYANT or The Boyant Group LLC. You agree that, to the maximum extent permitted by law, BOYANT has no responsibility or liability to you for UGC including any failure to or delay in removing UGC.     3.0 Access to Services

        3.1 Access to Services

BOYANT is a platform that facilitates the marketing of products and services for the tourism ecosystem and its value chain.  BOYANT is a platform that makes it easy to discover, plan, purchase and service, and navigate vibrant destinations.  Our platform connects travelers and visitors with merchants in the tourism and cultural value chain to promote their vibrant destinations for the sustainability, resilience and development of their ecosystems.


We support BOYANT travelers and visitors create their profile on the platform and with this they access the content and tools to plan, buy and navigate their trip or visit to the vibrant dream destination.  Similarly, we support merchants, businessmen and entrepreneurs in the value chain by selling curated offers of experiences and buying advertising and promotion plans that we call Boyants Visas.  Merchants enter www.boyants.com create their profile on the platform and with this access digital tools to activate the marketing of their products and services.


To transact and use the services on our platform you must be at least thirteen (13) years old.  As a condition for the use of the services, you declare and guarantee that all the information provided by you in the course of your use of the services is true, accurate, current and complete, you are solely responsible for ensuring that the use you make of the services complies with all applicable laws, rules and regulations.  There are commercially available parental control protections ("parental control") (such as computer equipment, programs, or filtering services) that may assist you in limiting access to harmful material to minors.  Information on these protections is provided on third-party Web sites, such as onguardonline.gov of the Federal Trade Commission and / or getnetwise.org of the Internet Education Foundation.  These web sites, their owners, or the providers that any service or product mentioned therein are not related, affiliated, endorsed, sponsored or sponsored by The Boyant Group LLC.  These websites, their owners, or the providers of any services or products mentioned therein do not endorse, sponsor or sponsor The Boyant Group LLC, its products or services.  If you wish to purchase and install such protections, you do so at your own cost and risk.

You agree to comply with the terms and conditions of use imposed by any merchant with whom you choose to trade, including, but not limited to, payment of all amounts when due and compliance with the merchant's rules and restrictions regarding to the availability and use of the products or services.  This includes the obligation to pay any applicable tax, at the time of redeeming any ballot with the merchant, as required by the merchant.


By accepting these TCs, you represent and warrant that (a) you are not currently suspended and that BOYANT has not previously prohibited you from using the services;  (b) are not acting on behalf of a competitor of BOYANT;  (c) you will not create more than one BOYANT account;  and (d) have full power and authority to enter into this legally binding agreement and, by doing so, you will not violate any other agreement to which you are a party. 


We reserve the right, in our sole discretion, to deny access to the services to any person at any time and for any reason, including, but not limited to, the violation of these TC's.


By accessing or using the website, you may be exposed to content that is offensive, indecent, inaccurate, objectionable, or inappropriate.  BOYANT does not endorse such content and cannot guarantee its accuracy.  Therefore, you access and use the website at your own risk.


Every user has the responsibility to review the TC's before accessing and / or using the services, channels and / or contents.  By accessing and / or using the services, channels and / or content, it will be understood that the User has accepted the TC's and any amendments, modifications, additions and / or substitutions to the TC's.


Any user who accesses and / or uses the services and / or contents through any of the channels or in any other way, accepts and acknowledges that access and / or use of the services, channels and / or contents are expressly conditioned to compliance with the TC's.  The User must access and check the TC's periodically.


BOYANT may expand, change, suspend, cancel, limit, prevent access or discontinue any presentation, configuration or other aspect of the services, channels or any content at any time without notice or prior notice, including the availability of any function of the services, channels, database or content.


        3.2 Accounts and Password


You will need an account in order to purchase BOYANT offers. BOYANT may require you to provide a unique username using your email address or other identifier, a password, date of birth, title, name, address, country, telephone number and financial information to create a user account with us. You must provide accurate and complete information and keep your user identification details updated. You will not use as a username a name of another person with the intent to impersonate that person. You are responsible for maintaining the confidentiality of your BOYANT Account password and log-in credentials ("BOYANT Account Credentials"). You are also solely responsible for all activities that occur in connection with your BOYANT Account. 


You will need to register by creating a profile account at www.boyants.com (an "Profile Account").  You can create an account, Traveler User or Business/Merchant User, through any of the following methods: (1) registering directly through our website, creating personalized log-in information ("Registration Information"), or (2) by enabling access to BOYANT through your Facebook or Gmail profile. By using the services through Facebook or Gmail, you permit us to access information from your facebook profile in accordance with our privacy policy. You may control the amount of information that we can access by adjusting your Facebook privacy settings. By using the services you are authorizing us to collect, store, retain, and use all information to you permitted facebook to provide to us in accordance with our privacy policy.


Your BOYANT Profile Account is for your personal use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create a BOYANT Profile Account for any person other than yourself, provide an e-mail address or other personal details other than your own, or create multiple Boyant Accounts.  All user identification details, passwords and other pieces of information provided as part of our security procedures must be treated as confidential and should not be disclosed to any third party. You will be solely responsible to Boyant for any activities that occur under your User account and we are not responsible for any problems with your user account due to misuse of your identification details and/or passwords. 


You agree to notify us immediately of any unauthorized use of your Boyant Account. If you become aware of or suspect any breach of the security of any portion of the services, you agree to notify us immediately at support@boyants.com You will not use another person’s user account or identification details to use the services without permission. We have the right to disable any User account or password, at any time, if in our sole and absolute opinion the User has failed to comply with any of the provisions of these TC’s.


We may terminate or suspend access to your BOYANT Profile Account or your ability to use the services, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. For example, we may terminate or suspend your BOYANT Profile Account or ability to use the Services if you misuse the Website. Any such termination or suspension could prevent you from accessing your BOYANT Profile Account, the website, user content, website content, and/or any other related information.


You may terminate your BOYANT Profile Account at any time by contacting us to request that we close your BOYANT Profile Account, and by discontinuing your use of any and all parts of the Services. If you close your BOYANT Profile Account, we may continue to display your previously published user content and are under no obligation to remove any of your user content.


As user of services, you understand and agree that: neither BOYANT Profile Account nor its affiliates will have any liability to you or others for any unauthorized bookings made using your BOYANT Profile Account and/or any BOYANT Account credentials; and the unauthorized use of your BOYANT Profile Account and/or Boyant Account Credentials could cause you to incur liability to both BOYANT and other users. In order to access or use such services, channels and / or content, the user must accept such particular rules of use, as they are modified from time to time.  In the event of a discrepancy between these TC's and the particular rules of use, notices, guidelines and / or rules mentioned above, such particular rules of use will always prevail.


        3.3 General Content

The use of, or access to, some services, channels and / or content through any equipment or device could entail charges to be imposed and charged by the operator and / or provider selected by the user.  The user will be responsible for any charge and / or cost that the user incurs to access and / or use the services, channels and / or content, including, without limitation, the payment of taxes and other applicable charges.  For example and without limitation of the foregoing, the user could subscribe for The Boyant Group LLC to send messages with alerts and / or content via email, "push notifications", SMS or MMS.  The user could subscribe to receive such messages through the services or channels, allowing or programming their mobile device to accept or receive "push notifications" from The Boyant Group LLC or by sending a message to the specific number or code for the messages that the User wishes. receive.  By subscribing, the user accepts and agrees that The Boyant Group LLC may send or transmit alerts and / or content via email, push notifications, SMS or MMS to the mobile device or to the email address provided by the user, as the case may be.  The user will only be sent those messages that he expresses and has previously requested and authorized.  Currently BOYANT sends the messages free of charge.  However, the user acknowledges and accepts that certain charges for messages and data (“Messages & Data Rates”) may be imposed by the operator or provider of mobile or wireless telephony services (“wireless”) of the user by or based on the receipt of, or access to, messages sent by BOYANT. For more details, the user must contact his operator or service provider. The user accepts and acknowledges that he will be solely and exclusively responsible for the payment of said charges.

For clarity, the licence granted to us (i) includes our right to use such content for commercial purposes such as, without limitation, advertising campaigns or sponsored content and you shall not be entitled to any remuneration for such use, (ii) applies to your name and picture, to the extent that such content includes your name or picture, and (iii) also applies to any content made available by Users when using the #boyant #boyants #boomingdestination hashtag or other BOYANT -specific hashtags on Instagram, Facebook, Twitter, Tik Tok or on any other platform or in the context of any other social media campaign calling for image submissions.


For clarity, the foregoing licences do not affect your other ownership or license rights in content provided by you; you retain all copyright. If we are notified in writing of any actual or alleged infringement of the intellectual property rights of any User, or any third party, we will make corrections or remove the alleged infringing material if requested, to the extent necessary to comply with applicable law. The Boyant Group LLC will have the absolute discretion to accept and / or store or not information and / or content supplied, shared, sent, uploaded (“uploaded”), transmitted or downloaded by users in any format, in relation to, through , or as part of the services and / or any channel or medium (including but not limited to, MMS, SMS, and / or email).  The Boyant Group LLC will not compensate the user in any way for the information and / or content that they provide, share, send, transmit, upload (“upload”) and / or download in any format, in relation to, through, or as part of the services and / or any channel or medium (including but not limited to, MMS, SMS, and / or email).  All information and / or content provided, shared, sent, transmitted, uploaded, downloaded and / or stored by users in any format, in relation to, through, or as part of, the services, and / or from any anal or medium (including but not limited to, MMS, SMS, and / or email), in public spaces or areas or in a way that implies that it could directly or indirectly be or become available for use, review or public or third party access, information and / or public content will be disclosed that may be disclosed by The Boyant Group to third parties (including, but not limited to, any of its affiliates) without limitations and The Boyant Group LLC may disclose to third parties (including, but not limited to, any of its Affiliates) without limitations the name, identity, username ("user name") or screen ("screen name"), image, photo, avatar or other information of the User that supplies, shares , send, transmit, upload (“uplo  ads ”), downloads and / or stores said information and / or content.

The user acknowledges and accepts that The Boyant Group LLC does not endorse the contents supplied, sent, shared, uploaded, transmitted, downloaded or stored by the users nor does it assume any responsibility in relation to the material contained therein, including but not limited to without being limited, to content that may constitute a threat, slander, defamation, obscenity, harassment or offense or that violates the rights and public freedoms of people, right to privacy, intellectual property rights of third parties or that induces the commission of a crime.

The user acknowledges and accepts that The Boyant Group LLC will have the right (but not the obligation) to, in its sole discretion or without prior notice, reject or delete any material or content that the user supplies, shares, sends, transmits, uploads (“ upload ”), download and / or store in relation to, through, or as part of, the services and / or any channel and that the user will be solely responsible for any violation of third party rights caused by the material or content provided, shared, sent, uploaded, transmitted, downloaded or stored by the user.  Without limiting the foregoing, The Boyant Group LLC will have the right to reject or remove any material or content that violates the TC's or is objectionable for any reason.  The Boyant Group LLC may, in its sole discretion, terminate immediately and without prior notice or liability the access and use of the services to the user and hold the user responsible for any obligation that may arise from the material or content provided by the user.


The user acknowledges and accepts that The Boyant Group may, at its sole discretion, preserve content supplied, shared, sent, uploaded, transmitted, downloaded or stored by the user and information about said user.  The user acknowledges and accepts that The Boyant Group may disclose said content and the user information thus preserved if it is required by any law or if in good faith The Boyant Group considers that such disclosure is reasonably necessary to: (a) comply with a requirement legal, (b) enforce the TC's, (c) defend against claims related to said content or (d) protect the rights, property or safety of The Boyant Group, its employees and / or affiliates.


By supplying, sending, transmitting, uploading, downloading and / or storing content in relation to, or as part of, The Boyant Group's services, channels or content, the user represents and warrants that: ( i) the content supplied, shared, sent, uploaded, transmitted, downloaded or stored is totally original and that the user is the owner of all the rights over said content and / or has the right to authorize the licenses that The user hereby grants The Boyant Group;  (ii) the use, display, reproduction, publication, or distribution of the content supplied, shared, sent, uploaded, transmitted, downloaded or stored by the user does not violate the rights of privacy, publicity, author, moral rights of author, trademarks, patents, business secrets, in the own image, contractual or any other right of any person;  (iii) the use, display, reproduction, publication, or distribution of the content supplied, shared, sent, uploaded, transmitted, downloaded or stored by the user does not violate any law, rule, regulation, ordinance or any other legal obligation that may be applicable and / or that the User must comply with;  (iv) the user has not entered into agreements, concessions, contracts, licenses or has made commitments that may be in conflict, be contrary or limit the exercise by The Boyant Group of any license granted on the content that has been supplied, shared , sent, uploaded, transmitted, downloaded or stored;  and, (v) there is no claim or action pending presentation, presented or suspected, that may affect the licenses that the user grants to The Boyant Group on the content that has been supplied, shared, sent, uploaded (“uploaded”), transmitted, downloaded or stored.  The user is responsible for the payment of all royalties, fees, and any type of compensation due to any person for any content supplied, shared, sent, uploaded, transmitted, downloaded or stored by the user.  The Boyant Group will have no obligation to conduct an independent investigation to determine whether the representations made above are true and correct;  and any investigation that The Boyant Group carries out for that purpose, either directly or indirectly, will not constitute a defense in any action that may be brought based on a violation of the representations made here.

When you use the Boyant website , or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically and agree that we may communicate with you in a variety of ways, such as by e-mail, in-app push notices, or by posting notices and messages on the Website. You can contact us in order to (1) update or correct your personally identifiable information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personally identifiable information maintained about you on our systems (subject to the following paragraph), by cancelling your account.
